Under the new rules, EU countries would set jail terms of at least one to three years for "publicly inciting to violence or hatred ... directed against a group of persons or a member of such a group defined by reference to race, color, religion, descent or national or ethnic origin."
However, the agreement doesn't specify what constitutes incitement to violence, leaving that up to national courts to define.
There will also be no Europe-wide ban on the use of Nazi symbols or Holocaust denial. It is the third time the EU has attempted to form common rules on racism and hate speech, previously without success.
